The Allahabad High Court delivered a sharp rebuke to both the three victims and the 19 accused involved in a case under the SC/ST Act, 1989, exposing what it termed as a severe misuse of the law's protective provisions.
A bench led by Justice Shekhar Kumar Yadav dismissed the criminal appeal filed by the 19 accused under Section 14-A (1) of the SC/ST Act. The court directed the three alleged victims—a Dalit woman and her two daughters-in-law—to repay the full compensation of ₹4.5 lakh they had received from the State Government.
Simultaneously, the court imposed a penalty of ₹5 lakh on the accused for manipulating the victim and attempting to undermine justice.
On November 4, 2025, the counsel for the accused claimed that the FIR was lodged using the complainant’s thumb impression. This claim was firmly refuted by the complainant’s counsel, who stated that no such FIR was ever filed by the victim.
The court, aware that the complainant belongs to the Scheduled Caste community, expressed concern that the accused might have exerted undue pressure on her.
"Serious abuse of the process of law and a gross misuse of the benevolent provisions of the Act."
Author’s summary: The Allahabad High Court penalized the accused for exploiting the SC/ST Act, ordered compensation repayment, and highlighted concerns over victim manipulation and legal misuse.
